Overview of the High Court
The High Court of LegisCraft is the supreme judicial authority of the server. It is an independent branch of government tasked with interpreting the Constitution, resolving disputes, and ensuring that all laws and actions comply with the supreme law of the land.
The authority and structure of the Judiciary are established in § V of the Constitution.
Judicial Authority
The judicial power is vested in the High Court and any inferior courts established by law. The Judiciary is independent and bound only by the Constitution and the law.
Jurisdiction
The High Court has original jurisdiction over:
- Constitutional Disputes: Questions regarding the interpretation of the Constitution.
- Branch Conflicts: Disputes between the Executive and the Legislature.
- Rights Violations: Petitions alleging infringement of rights guaranteed by the Constitution.
- Appeals: Hearing appeals from decisions made by lower courts.
Composition
The High Court consists of an odd number of Justices (minimum of three).
- Nomination: Justices are nominated by the Chancellor.
- Confirmation: Must be confirmed by a three-fifths vote of the Curia.
- Tenure: Justices serve during a period of "good behavior." They hold their office until resignation, incapacity, or removal.
- Removal: Can be removed by a two-thirds vote of the Curia, with the concurrence of the Chancellor.
Powers & Procedures
The High Court possesses significant powers to check the other branches:
- Judicial Review: The power to declare laws or executive actions unconstitutional and void.
- Injunctions: Issuing orders to compel compliance with the law.
- Interpretation: Serving as the final arbiter of the meaning of the Constitution.
Decisions of the High Court are binding upon all branches of government and all inferior courts.
Independence & Impartiality
To ensure fair justice:
- No Conflicts: Justices cannot hold any other civil or political office.
- Freedom from Influence: Justices must exercise their functions free from intimidation or interference.
- Due Process: All proceedings must be fair, public, and orderly.
Access to Justice
Every Citizen has the right to bring lawful claims before the courts. The Judiciary ensures that no person is denied access to justice on arbitrary grounds.
